The terms that govern the sale, delivery and use of the digital works published on fisniku.art.

fisniku.art is published and operated by GreenEcoGenius OÜ, a private limited company incorporated under Estonian law (Osaühing) with a share capital of EUR 10,000, registered with the Estonian Commercial Register under code 16917315, with its registered office at Tornimäe tn 5, 10145 Tallinn, Estonia.
The company is represented by its management board member, Ervis Ago. All correspondence may be addressed to info@fisniku.art.
These terms of service govern the use of the site and any order placed by a customer (the "Customer") with GreenEcoGenius OÜ (the "Seller"). Placing an order implies full and unreserved acceptance of these terms.
fisniku.art offers for sale the literary and artistic works published by Kandera Editions, an editorial imprint operated by the Seller, in three distinct formats:
Each format is offered in French and in English. The full catalogue is available at /livres.
Orders are placed from the page of a work. The Customer selects the desired format, validates the choice and is redirected to the secure checkout. The contract is formed at the moment the payment is confirmed by the payment provider and the Seller confirms the order by email.
Before validation, the Customer is asked to create an account or to sign in. This step is required to attach the purchase to a personal space and grant access to the acquired content. Information provided must be accurate; the Customer warrants its truthfulness.
Prices are displayed in euros (EUR), all taxes included for consumers residing in the European Union. The applicable VAT is calculated automatically by Stripe Tax based on the Customer's country of residence, in accordance with the European One Stop Shop (OSS) scheme to which the Seller is registered.
Prices may be modified at any time. The price applicable to an order is the one displayed on the page of the work at the time the payment is validated.
Payment is processed by Stripe Payments Europe, Limited, an Irish company authorised as a payment institution by the Central Bank of Ireland. No banking data of the Customer is stored on the Seller's servers; all transactions are protected by the PCI-DSS Level 1 standard.
Accepted payment methods are: credit and debit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay and SEPA direct debit. The availability of each method depends on the Customer's country of residence.
Delivery is strictly digital and immediate. As soon as payment is confirmed, the acquired work appears in the Customer's personal library, accessible at any time at /home after sign-in.
Reading ebooks and listening to audiobooks happens exclusively through the fisniku.art web application. No file (PDF, EPUB, MP3) is made available for direct download. Access is granted for life, with no subscription and no renewal, subject to the Customer's account remaining active and to compliance with these terms.
In accordance with article 16, m of Directive 2011/83/EU of the European Parliament and of the Council on consumer rights, the right of withdrawal cannot be exercised for the supply of digital content not provided on a tangible medium where performance has begun with the consumer's prior express consent and acknowledgement that the right of withdrawal is thereby lost.
By validating the order, the Customer expressly acknowledges that access to the work is opened immediately after payment, accepts the immediate performance of the contract, and expressly waives the right of withdrawal for the acquired work. This waiver is final and the order is neither refundable nor exchangeable.
The works offered on fisniku.art are published by Kandera Editions. All intellectual property rights attached to them (texts, audio recordings, illustrations, layouts, designs, visual identity) remain the exclusive property of Kandera Editions, of the authors and of the relevant rights holders.
The purchase of a work grants the Customer a strictly personal, non-transferable and non-commercial right of use. The Customer in particular agrees not to, this list being non-exhaustive: reproduce, copy, share, distribute, retransmit, host on another service, modify, adapt or translate the work, in whole or in part, in any form or on any medium whatsoever.
Any violation of intellectual property rights constitutes counterfeiting and exposes its perpetrator to the civil and criminal sanctions provided for by applicable laws.
The Seller undertakes to apply all necessary care in providing the works in accordance with industry best practices. The Seller's liability cannot be engaged for any indirect damage, loss of opportunity, or intangible loss resulting from the use of the site or of the acquired works.
The Seller cannot be held liable for temporary access interruptions to the site caused by maintenance operations, by the failure of a third-party provider (host, internet access provider, payment processor) or by any case of force majeure.
The collection, processing and protection of the Customer's personal data are described in detail in the Privacy Policy, which supplements these terms.

These terms are governed by Estonian law, without prejudice to the more protective mandatory provisions applicable to the consumer in the country of habitual residence.
In the event of a dispute, the parties shall endeavour to find an amicable solution. Failing that, and for disputes that do not fall under the consumer's exclusive jurisdiction, jurisdiction is granted to the courts of Tallinn (Estonia). The consumer may also resort to the European Online Dispute Resolution platform available at ec.europa.eu/consumers/odr.
The Seller reserves the right to modify these terms at any time. The version applicable to an order is the one in force at the time the payment is validated, archived and available on simple request at info@fisniku.art.
